Dear all,
I have got a employment offer from employer in Mississippi. I am currently in H1B status. When I am looking for filing address, I am confused by the following information on the I-129 instructions sheet:
Regular Processing
Except for the classifications listed below, Form I-129 is filed either at the CSC or VSC, depending on the location of the temporary employment.
Exceptions:
Additionally, H-1B employers filing petitions which are cap exempt must file at the CSC.
My question #1, I am cap exempt due to H1b transfer so I should file to CSC but employer location is in Mississippi so I should file VSC as per employer location.
Please clarify me the filing location.
My question #2, In sections 2.2 and 2.5 of I-129 form, am I currect If I check e for 2.2 and c for 2.5??

I had similar situation few years back after my I-140 approved, but before applying I-485.
As long as your job title, description and place of work won't change, then you are ok. When you apply I485 or H1B ext, then your attorney must submit a document (successor of interest or similar document), telling that your role and place don't change.

HI,
I am in my 7th yr extension of H1B, last time I got the stamping in Ottawa in 2005. I cam e into US on F1 and never got H1B stamping in India. Am I eligible for H1B stamping in Canada for my 8th year or should I go to India to get the stamping done.

My case was approved by BEC on July 18. My attorney says that my 140 has to be filed by July 31 to be eligible to file under July visa bulletin [by 17th August]
Is his interpretation correct?
I can not do concurrent for a few more days, until my family returns from India.
If I go with 140 now, I am afraid the 140 receipt may not arrive in time for me to file for 485.

Hi,
Thanks for my previous response. I am on H1B and between projects. I have an offer to work for a couple of days for a company other than the one holding my H1B. They said they are not gonna report to the IRS as its an hourly job for 2 days and the number of hours are not going to accumulate enough for the IRS. But they need my SSN or tax-payer ID to run their payroll. I am gonna receive my dues as a simple check (like a rebate check with just the total amount showing up & NOT a paystub). Please let me know if I can work for them or not.

I have filled with only one check for all (self+wife) my I-485/AP/EAD. All application receipted without any issue.

I have got my I 485 rejectd when i filed during AUG 2007 due to Improper fees but we paid the correct fees.We refiled with saying "Improper Denials of I-485 " and double packed saying byboss mail room. We tryied more than 5 times always we got back saying PD is not current. Please advice me how to proceed on this.

I think the mail room does not handle such mail. You may need to file an MTR. Contact a good attorney - I did read on Sheela Murthy's website that USCIS is improperly handling the July 17th to August 17th 2007 filing as they go by August 2007 fee schedule.
I think if it is a mistake on their side, usually theey return the MTR fees. I am not sure though.
Try contacting DHS Ombudsman's office and see how they can help.
But the first thing I suggest is to talk to a good Attorney.

I Just heard back from my Fortune 500 company that they will accept the replacement card receipt notice...so it may work. It will help to specifically ask the HR/Lawyer to check the Receipt rule.

Hi,
I need your help on this tricky (at least for me) situation. I am a Software Developer right now and want to chanfe my job to a PM (product manager), but within the same division, same employer. Apparently the job descirption of PM (like new product functional design...) will be different from the one of developer (like new product technical design, coding...).
Right now, my GC status is: PERMLC got approved Dec/2006. I-140 was filed on Feb/2007 and still pending. I-485/AP/EAD were filed on Aug/2007 and pending.
My questions are:
1) I know the AC 21 law, say after Feb 2008(180 days after my 485 filing) and if the 140 gets approved by then too, I can do ANY job change within teh same employer or even switch to another employer, is this true? Or, I still have to stick to the similar job type(SW developer in my case), no matter within a same employer or different one?
2) Before I can use AC21, say from now to Feb2008, I know I can not switch to another employer. But can I change my job to PM with the same employer. Will this affect my 485/GC case? If so, is there any solution or workaround so that I can change my job "smartly" without affecting 485?

My 485 case is pending under EB3 category but my employer has already filed for EB2 labor which got approved and now I want to know if I can apply I140 for EB2 to interfile under 'Premium' Category? Are there any restrictions on applying I140 under premium processing?

This is my situation
I am from Pakistan and I do have Canadian PR also. I applied I-824 on August 5, 2008 and it got approved very fast on January 16, 2008 IN just 5 and half months and I have written that I want to process my case in Toronto Canada not from Pakistan now I have the following question
1-on approval notice the petitioner name and the beneficiary name is the same don�t u guys thing the beneficiary name should be my wife name
2-DO all FTJ cases are processed through NVC. Or only some of them... because Islambad embassy accept cases from NVC only they told me that I-824 has to be approved and then UCIS will send your case to NVC and then case will be sent to islamabad but is this the same procedure for canada because I-824 approval notice says that they have notified tornto consulate that I am the permenant resident thats all. I 824 do not have even my wife name?? Can any body tell me clearly that does every body who files I-824 has to go through NVC or in case of Canada we can go to consulate and start the case?
3-If NVC is involved in my case then how long file will stay at NVC and how long the consulate in Toronto will take to complete the process.
I am totally confused a lot of lawyers do not even know that NVC is involved in FTJ cases. These lawyers still say that you can go too directly to start the case I know In Pakistan they accept the cases only through NVC. Even they don�t open case with approved I-824? What about in Canada?
