Dude are you kidding me ... I am reporting a violation/fraud and I should hold my head down?? what kind of moral/ethical values you have.. I am keeping my head up (may be an inch or 2 higher than last 3 weeks) as my project manager and director (middle management ) fully supports me in this crusade. Most of the cases, upper management decides to replace all the local contractors with these outsourcing firms and once the contract is signed these companies dump all their L1 resources to projects and middle management who deals directly with the resources has minimal say in the process.
Let me ask you a simple question.. WHY ARE YOU SUPPORTING THIS FRAUDULANT ACTIVITY??? .... think for a minute and then decide whether to reply me back or not.. bye.
'Mileage for this complaint'.. in an economy when millions with eligibility are job less .. case regarding this fraud will have ZERO mileage! want to bet me on this .. come on dude.. come on. If you are on L1 visa talk to uer management and get it changed to something legally eligible to work on your project, instead trying to measure the mileage of L1 fraud, ICE/USCIS will measure that and we'll see whos head is going down here...

Your client and director who ever they are , they might be saying one thing on the face and getting ready to save their company in the background. You know corporate world is a nasty place. Every recruiter who talks to you makes you feel as if he is the hiring manager and you have got the job, but does it happen that way? No. Similarly, your client is buying time and soothing you, I am not sure they are sincere about their comments. Everyone has some motive or personal interest in supporting things.
And to be honest, I doubt if you can come clean , hold your head high and say in public, I did it. If you do so , I will respect you as a whistleblower. Other wise, you are just mad that your are losing the job to others. If they cant get l1 on site, they will send the job offshore. There is not much you can do. Your client is towing your line until a smooth transition and then they are done with you , anyways. Its better you read writing on the wall and move on. You can invest the same time in finding other work and still have good relations with the current client. You never know when economy gets good, they may want you back at a higher price. But if they get to know you are doing this, most likely you will end up on some blacklist and I am not trying to scare you but world is a small place and you will run into same people many times.

I am moving on without a bad taste in mouth or complaint. It is company's choice whether they want to pay me or someone else. My priority Date is EB2 May 2006. I will be current if the dates got moved.
I will be out of the country for the entire month of May.
Please let me know if it is acceptable to be out of the country during 485 approval.
Also please let me know what I need to do at the port of entry.
May not be acceptable. As soon as your dates become current, I guess you will be eligible to file for 485 on May 1st. and you must.
Come June 1st and if they retrogress, for some reason, you will miss it.

It is received date stamp, what they do after receiving. They do it immediately on the same day.

Isn't is written somwhere that if the last day of a month falls on a saturday or a sunday then they accept the applications on the next working day even if it falls under next month.
Last day of June is a saturday and so won't they have to accept the june applications on Monday???/

I am really frustrated now. Whats the use of my doing every effort to make sure my application reaches the first day. Why is USCIS receipting cases from August when so many july 2 filers are still waiting? Should we all send some inquiry into our cases together?
We should start contacting congress man/woman in our area and need to start escalating it. Do we have any other options?

Thus the GC journey of 9 years and 8 months ends. Currently no difference in life it makes. May be when i travel GC may be of more help. (no AP H1B stuff to worry about)

Saimrathi, you are posting the same message on all threads. Anyway, I am sure some of the media will pick up the story and write about it. I think there are benefits from this campaign. The name Immigration Voice is out there. We may get more members of our community to join us and participate in future campaigns and we can learn from experience on how to carry out future campaigns, protests etc. We had to speak out in some way on what happened to us with the USCIS Visa Bulletin fiasco. I believe it was worth it for all these reasons.

We had soft LUD's on Sep 4th on all I-485 applications in my family and on the (July 2007) EAD for my spouse. My PD is Feb 2007.

In response to this event, Academy Award Nominee Vidhu Vinod Chopra, who produced the run-away successes "Munna Bhai MBBS", and "Lage Raho Munna Bhai" stated, "Mahatma Gandhi has influenced several personalities, including American Civil Rights Leader Martin Luther King, Jr. These young, law-abiding professionals have set out to strive for reform the right way- the Gandhigiri way."
The theme of �Lage Raho Munna Bhai� centers on the usage of non-violent principles to win over difficult and non-co-operating entities. In the movies, character Munna Bhai wins over the tough Dr. Asthana by means of chain deliveries of flower bouquets. The sequel has revived Gandhian principles and popularized the concept of Gandhigiri- literally meaning a symbolic act of peaceful protest across South Asia and the UK.
Rajkumar Hirani, who has directed the Munna Bhai series, had this to say - "When you feel you have been wronged, you feel angry. The best way to overcome what you think is unjust, is to protest peacefully. Be nice to your opponent and let him see your point of view. My well-wishes go out to these educated, highly-skilled professionals who have abided by the law and have been eagerly waiting in line for their Green Cards for nearly ten years."
Boman Irani, who plays hardball Dr. Asthana in the popular series, shared his views � �Gandhigiri is a tool that makes your opponent see your point of view without losing your dignity. With aggression, one usually loses focus over the main issue, whereas good behavior makes the other person open up a dialogue. What�s key is to keep the efforts ongoing � Gandhigiri isn�t easy, but works in the long run!�.
The film personalities shared their solidarity with Immigration Voice, a not-for-profit group that advocates highly-skilled immigration reform.
�Expectations ran high among applicants. Highly-skilled professionals and US employers have incurred financial expenses averaging USD 3,000 or more, per family in just filing and preparation fees, not including the rush to get medical examinations completed on time, or the resulting hurry to get supporting documentation from home countries. Several applicants have had to call off vacations or business trips to be in the US to file �adjustment of status� applications as part of the final stage of the Green Card process. Some applicants or their representatives even traveled personally to Immigration Service Centers to be the first ones to submit. Not to mention the downtime that has resulted in lost productivity to several US businesses", says Aman Kapoor, of Immigration Voice. Aged parents and families in home countries were inconvenienced to source supporting documentation such as birth and baptismal certificates, all resulting in naught.

Hi
I have a approved i140 with priority date of Dec 2004 EB2. My spouse has approved i140 with priority date Mar 2006 EB2.
Since it is not recomended to apply 2-1485's we decided to settle on mine. But then, since we both have our H1's for next 3 years, we don't want to use EAD and AP till the final process of GC is done.
My question is should we apply for EAD and AP or not. This question exists in the questionaire given by my employer.
Please advice.

Its just that i think if IO see's that there is an H1 transfer application pending, he may delay the AOS with the current sponsor. I am just mentally preparing myself, havent seen any change in online status.
Looking back, it might have been better to just go with EAD, that way USCIS wouldnt even know I am changing jobs then :D

i received reply to my inquiry email from mumbai consulate. and they wrote following in email
"Please wait till you get an email from us.

I also visited the inquiry window at mumbai consulate personally and here is the coversation I had..
me: I had my H1b visa interview on feb 11 and I want to know the status of my visa.
she: what is your name (did something on computer). it is still pending for verification
me: how long will it take?
she: it might take another 1 or 2 weeks
me: i was initially told that it will take only 1 week and it is already more than 2 weeks.
she: it takes time
me: what is the procedure to withdraw my visa application
she: if you withdraw, how will you go there?
me: i have advance parole document with me
she: it is advisable to wait for this visa. if you go on advance parole, you might be inquired at port of entry.
me: i have to find some other option as my client is waiting there.
she: if you want to withdraw, you can send an email or you can come here personally but it is advisable to wait for this visa (she said it again).

Hi,
I am happy to share the news that I received CPO hard copy on exactly Diwali Day. Lord Ramachandra Ki Jai.
Here are the details of my case and what did I do to get this CPO mail. It may help others to follow up with USCIS.
1. Applied EB-3 India in July 16th 2004 .
2. Waited for about until 2006 July, but no signs of EB-3 labor approval.
3. Applied EB-2 labor under PERM Sep 2006 and got approval in 7 days. this was amazing………..
4. Applied I-140 for EB-2 labor in Oct 2006 and received approval after 6 months, still my EB-3 labor not approved.
4. Applied I-485 on July 2nd 2007 along with my wife with EB-2 PD Sep 20th 2006.
5. Received the receipt notice with the notice date of Aug 30th 2007 and receipt date of July 2nd 2007.
6. Received the Finger print notice on Oct 15th 2007 and gave finger prints on Nov 10th 2007.
6. Received the EB-3 labor approval in Dec 2007 and applied for i-140 for eb-3 and received i-140 approval in June 2008.
7. Now I have 2 i-140 approvals one EB-3 with pd of July 16th 2004 and other eb-2 i-140 with Sep 20th 2006.
8. Changed to better attorney who can better handle the i-485 in terms of the PD transfer and follow up with USCIS.
9. Attorney sent Priority Date porting request to Texas service center in June 2008 along with new g-28 forms.
10. Called at least 4 times in 2008, but got the response that my processing dates are not current yet means. Not reached the July 2nd 2007 or Aug 28th 2007 which is my i-485 notice date.
11.In June 2009 Called USCIS POJ method and got some nice officer in Texas service center who opened the SR to open my case as my case is out of processing time.
12. Got soft LUDs in June 20th 2009 and called usics cust service and came to know case is assigned to an officer.
13. In July 20th 2009, got email update saying the case is transferred to NBC for further processing.
14. Next day again got email, case is transferred to NBC and I will receive the interview notice.
15. Got interview notice to go to local office on Aug 5th 2009.

17. Went for the interview on Aug 5th 2009 to local USCIS office along with my wife, office was very nice. Officer asked general questions which are on i-485 (like have u been arrested, have you been involved in terrorist activities etc.) form and questions about my wife's name and marriage date etc.. Officer did not ask even for employer verification letter also, I myself handed over that letter to her. She did not even saw that letter.

These details will not be known to applicants. My attorney sent an hard copy request on Sep 5th 2009 to local USCIS office to adjudicate my case as my PD is current.
20. Waited until Sep 15th no update was received from Local USCIS office or no update on i-485 LUDs online.
21. Took info pass on Sep 16th 2009 and went to local USCIS office and got nice Info pass immigration office, very co-operative officer. He told me that my case is now back to central storage location and waiting for the visa no. I told him my PD is current, officer himself gave me an yellow form (please request for this form, otherwise they don’t give it normally) to fill up to send to other department supervisor in local USCIS office. Filled up and gave the form along with my i-485 receipt notices and i-140 notices. Officer asked me to wait 3 to 4 weeks to contact again. No luck until Sep 30th 2009.
22. On Sep 26th 2009, attorney sent an e-mail to local USCIS office and got the standard response on Oct 1st 2009saying to wait for 3 months etc..Again attorney received an e-mail on Oct 2nd 2009 that my case will be adjudicated soon.
23.On oct 4th 2009 took info pass again and went to local uscis office, again got nice infopass immigration officer and explained that they will request visa no only once (recently Murthy law firm posted that way USCIS and DOS dept interact) and I need to wait until visa no assigned by DOS. Gave again yellow form to sent to local USCIS supervisor to look into my case.
24.Called 1-800 number and asked if there was any update on my case, got very very nice supervisor from customer service center, and he told me that my case is now assigned to an officer on Oct 6th and I should see result in 2 or 3 days.
25Atttorney sent an e-mail again to local USCIS office explaining my PD porting details just to inform officer again.
26.Got CPO email Friday oct 16th and received courtesy notice of approval i-485 on Diwali day on Oct 17th 2009.
If the case is at local USCIS and your PD is current, please take info pass every 2 or 3 weeks, and request for yellow form and fill it up and give to info pass officer. This will help to move the case faster if the case is at local USCIS office.
Overall, please call repeatedly to USCIS cust service to get some good officers and you will really here somany good things from them. What I understood from my exp, that the customer service officers now far far better and good than 6 months back..Really thankful to USCIS for providing good customer service.

I am happy to share the news that I received CPO hard copy on exactly Diwali Day. Lord Ramachandra Ki Jai.
Here are the details of my case and what did I do to get this CPO mail. It may help others to follow up with USCIS.
1. Applied EB-3 India in July 16th 2004 .
2. Waited for about until 2006 July, but no signs of EB-3 labor approval.
3. Applied EB-2 labor under PERM Sep 2006 and got approval in 7 days. this was amazing………..
4. Applied I-140 for EB-2 labor in Oct 2006 and received approval after 6 months, still my EB-3 labor not approved.
4. Applied I-485 on July 2nd 2007 along with my wife with EB-2 PD Sep 20th 2006.
5. Received the receipt notice with the notice date of Aug 30th 2007 and receipt date of July 2nd 2007.
6. Received the Finger print notice on Oct 15th 2007 and gave finger prints on Nov 10th 2007.
6. Received the EB-3 labor approval in Dec 2007 and applied for i-140 for eb-3 and received i-140 approval in June 2008.
7. Now I have 2 i-140 approvals one EB-3 with pd of July 16th 2004 and other eb-2 i-140 with Sep 20th 2006.
8. Changed to better attorney who can better handle the i-485 in terms of the PD transfer and follow up with USCIS.
9. Attorney sent Priority Date porting request to Texas service center in June 2008 along with new g-28 forms.
10. Called at least 4 times in 2008, but got the response that my processing dates are not current yet means. Not reached the July 2nd 2007 or Aug 28th 2007 which is my i-485 notice date.
11.In June 2009 Called USCIS POJ method and got some nice officer in Texas service center who opened the SR to open my case as my case is out of processing time.
12. Got soft LUDs in June 20th 2009 and called usics cust service and came to know case is assigned to an officer.
13. In July 20th 2009, got email update saying the case is transferred to NBC for further processing.
14. Next day again got email, case is transferred to NBC and I will receive the interview notice.

I agree I too have never seen H1B only ad's anywhere even body shoppers never post this kind of ad which is blatant discrimination. .

The case was brought against iGate Mastech for placing an ad for 30 programmers between May and June 2006 "that expressly favored H-1B visa holders to the exclusion of US citizens, lawful permanent citizens and other legal US workers" according to the US Department of Justice.
So-called citizenship status discrimination is prohibited by the US Immigration and Nationality Act. The DoJ said it is "committed to protection the right of all authorized workers in the United States against citizenship status discrimination".
Get your facts right before posting. mastech is not the only firm that did it. As you pointed out, many of these fly-by-night operators (and bigger outsourcing companies) offer below market salaries, pocketing the difference like parasites.
