I do not know if this has been posted on this forum..
But some of the testimonials are interesting for Students & STEM based EB applicants..
This is from Immigration-law:
02/14/2008: House Subcommittee Hearing on Status of Visas & Policies on Foreign Students and Scholars on February 7, 2008
The House had this important hearing that can have an impact on the employment-based immigration issues relating to the STEM foreign graduates in research and higher learning institutions. It is suggested that the EB immigrants in STEM to review the testimonies of witnesses in this hearing.
Purpose and Summary of the Subject
Testimonies of Witnesses:
:: Opening Statements by Rep. Brian Baird
:: Witness Statements ::
Mr. Tony Edson
Ms. Catheryn Cotten
Dr. Harvey Fineberg
Dr. Allan E. Goodman
Under the current political environment and a long pause in the employment-based immigration legislation issues in the Hill, this is indeed an important news in that at least the Congress is giving attention to the predicament the research and higher learning institutions are facing owing to the failure of the do-nothing Congress and the Administration to act on the matter.

My GC was started by a company A with priority date of June 2004 in EB3. 140 was approved and filed 485 in July 2007 when all gates opened. In parallel, a friend of mine started my GC processing under EB2. That has a priority date of March'2005. Current date for EB2 is Feb.2005.
I got an offer from a different company (company B), which I would like to take if I have no issues with GC etc. I am thinking what should be my plan of action. I have the following options:
1. Join company B on contract to hire on EAD that I got from company A as an employee of my friend's company. Apply 485 when EB2 becomes current for March 2005. Hopefully I will get my GC in an year and I join company B.
2. Join company B on EAD (or H1) and ask them to re-start my GC process under EB2. Issue with this is it may take a long time for my GC as PERM is taking longer nowaways.
3. Continue with my present employer and get my GC in 2020!..
Request your advice on the best course of action for me. Appreciate your help.

Guys,
I spoke to another Border Post official and he suggested that i drive uptp the nearest border and they would refuse my entry to Canada as i don't have a valid visa and i can turn around and come back to US and i can get a new I-94. Do you think it would be safe to do this ?
Any advices?

I like both, initially perhaps the color version a bit more. If you can touch up the slight red-eye problem. The faded border works better with the b&w though, so all in all I'd finally go with the b&w. Cute girls!

Hello --
Do any of you know what the A# is on the I-485 / I-130 / I-765 etc is for people who have previously held an F-1 / OPT-related A#? I have seen previous forums stating that OPT A#s begin with a "1" which connotes an OPT status; however I am not clear whether we are supposed to use that same A# on our I-485 and other GC-related documents, or leave that space blank.
Sorry this is redundant but previous posts don't seem to clarify a definitive answer to this question. Many thanks in advance.

Looks like an interesting option for those in health care if you speak Hindi, Tamil, Bengali, etc. to get US citizenship within a few months without going through the green card process mess...

All,
My PD is 11/2003 and my case was transfered to PA backlog center, I have not heard anything since then.
My employer wants to call the Senators and Congressmen to see if they can expedite this process.
Could you please provide some suggestions on:
1. What should the employer tell to the law makers?
2.How will the law makers help me?
3. Do you have any fax/email templates?
4. Any other suggestions?
Thank you all for your help.

Hello,
Has anyone used ICE MILLER as their legal counsel (immigration attorneys)?
I am planning to use AC-21 provisions to change jobs. My new employer is going to use ICE MILLER in Indianapolis to process my H1-B transfer.
I was wondering if anyone could share his/her experience with their staff and general suggestions. I would like to use them for any RFEs or filing any AC-21related documents.
Thanks in advance.

Your wife is fine. There is a CIS memo that specifically says that her H-4 status is not employer-specific. The only thing is that she will have a different expiration date to you. She would no get admitted for any longer than her visa, even showing your H-1B approval.

Hello All,
I have a certain queries regarding the transfer from L2 to H1B.
My husband is on L1 and me on L2 with my EAD still under processing. However my husband's firm wants to get his visa converted to H1 which automatically cancels my L2 status and I would have to apply for H4.
So now my query is for how long will his status of L1 be valid will it be till the start date of H1B, or the minute he files in his papers for H1B or when his H1B gets approved?
Thanking you in anticipation.
~Shruti
To my knowledge your L2 status goes away the day his H1-B is approved.
Gurus what do you say ?

Hi,
I am in the 485 stage, under EB2 India, but my spouse born in UAE. SO I can cross charge to UAE based on spouse country of Birth. My Employer agrees to files the AOS papers and forwarded to attorney but attorney is not yet agreed to proceed with the processing. He was telling that there is risk in this and need a close attention.
Any advice appreciated.
Thanks

I changed jobs twice after I-140 approval/180 - days of filing 485. I am in the 6th year of my H-1B. Both the times I transfered my H-1B and got validity for 3 years based on AC-21.
Now I know there is no formal form for AC-21. Most of the people send a letter along with some supporting documentation that their new job is similar to the old one. I didn't send any such letter, however when my H-1B transfers were done, the attorneys quoted AC-21 in the petition and got 3 year H-1B extensions.
My question is, would that consider notifying USCIS of AC-21, or is the 485 department different from H-1B department?
