I had applied for my H1B extn and got an RFE. Lawyers replied to it and its almost 7 weeks now, haven't got any reply.
Is this a usual timeframe? how long will it usually take for USCIS to take any action on the RFE's after the reply was sent with all appropriate documents?

If your boyfriend has degree+exp in engg, medicine, nursing, management, etc. he can get H1 from company that plans to hire him. Pl search for jobs on yahoo, dice, etc first. Not many companies would be ready to do H1 in present scenario.

I currently work for a leading film company in the US and hold a senior position under a O1 non-immigrant visa. Last year I applied for my GC under EB3, which was the choice made by my company . My priority date is Jan 2008 and I recently had my I140 approved. However, I have heard that given my work history and experience, I may possibly qualify as EB1 if I did not apply through company sponsorship. My question is, can I simply cancel my current application and re-apply myself under EB1 using my own lawyer? I am really hoping that I can change this category as the EB3 situation seems to be completely ridiculous.

Have you tried contacting your local congressman or senator's office? Many times, a request to take action on a pending case from a congressman's office has much better effect than a service request or infopass.

First of all you are on OPT and your status has not yet changed to H1. It will change to H1 in October.
Your company can cancel H1 with or without your knowledge.
Your new employer can transfer your H1 provided you have the receipt number EAC or WAC number.
If I were you, I would first get the receipt number from your employer and then join the new company on OPT. Also if things do not work out this way, you still join the new company as you are eligible for 17 months OPT extension, you can still qualify for next years H1.
Best strategy is to use as much time on OPT as possible because in that case you dont have to pay social security and medicare taxes.

I have two I -140's approved with one PD from end of 2005 and other end of 2006 both on EB2. I 485 is based based on 2nd one in 2006. So question is can I port 2005 pd to I 485 based on 2006?
Some where I heard that you can only port the PD when your 2nd is application stage and is pending. but here it is applied and already approved. Is it a good case for Porting PD or interfiling?
And by the way what is the difference between porting and interfiling?

Porting and interfiling are pretty much same ...( some use interfiling to use cross changeability ) .
you should be able to use your old PD ...Just ask your attorney to contact USCIS with your old I 140. and New I 140. Lot if times USCIS automatically links your PD's . But again its USCIS?? I think this is a step forward...but aint cutting it...your status remains "in process for years"...everyday check the same url and it says gives the same stale status...what we need is a way to make a resonably accurate guess as to when my LC will go into the next stage..

Is the namespace for your FontCollection.cs file the same as that of your Window1.xaml / cs file? The reason is, if I try the following code, I am able to see FontCollection appear in the data pane:

Hi..I was in a similar situation. Best thing for you to do is File for F2. Make sure you send dependent I-20 issued from your wife's school with your F2 application. Pay slips are only needed for changing status from H1 to F2, in your situation. No payslips are needed when you change status back to H1, because you are on F2 at that time. hope this helps.good luck.

I know people from India who got their GC approved when their PD is not current.
One can check this easily in looking for I-485 approvals to people from India who submitted their applications concurrently in EB2 category after say april 2004. Disregard the cases which got approved in July 2007. Still there are many cases remaining invalidating the 'rule'!
The strict rule is that one's PD needs to be current for approval. But if there aren't earlier PDs available for approval ( say stuck in namecheck ) and if USCIS doesn't want to visa numbers for a year to be wasted , then one can get approved even if PD is not current.
