Folks,
I've been hearing a lot of banter about the L1 Vs H1-B the fact remains both these categories are badly abused, it doesnt matter who is the bigger evil. I would tend to agree that L1 has a worse abuse rate however.
The issue however is that these so called "high skilled" visas arent high skilled anymore. If you closely look at the people coming in I would bet a majority of them who came during the dot com era didnt even have basic engineering degrees , and a huge majority of those coming in now have these degrees but from institutions which are completely crappy, the college plays a big role in framing who you are and yeah people can argue "there are bright students" in these colleges, but they are just plain minimal at best. So bottomline a majority of these are not highly skilled or talented people.
When the H1-B was conceived it was supposed to pave its way really skilled engineers with excellent credentials and it is not the case anymore, if you are going to tell me things like QA and Data Warehousing need mind boggling skills I think I can just have a good laugh at it. The local citizens are very much capable of executing on them. These jobs account for a huge majority of the software based jobs in the US, yes this is not the only category for H1-B jobs but software accounts for a big chunk.
I think of the H1-B visa as something analogous to getting into the best schools in India or the best schools out here, you cannot be crappy and get admitted to those schools, neither can you pay shit loads of money and get admitted, and this is what is happening. Consultants bringing in people from wherever charging them a huge sum of money filing for their H1-B and then looking out for a job for them, the only skill here is the consultants skill in finding the person a job :-). The new trend is the students with masters degrees from here getting placed in a job which is completely against what they specialised in, if a student after his/her masters doesnt find a job its either his badluck or he just wasnt good enough even after a masters and just isnt ineligible and these consultants have found a way to place the inept students as well which sucks at best. I do not agree with the notion of good consultants, every consultant abuses the employment based Visa system, and I am for a cap on L1-B visa's or a limit thats decided by the number of employees a firm employs in the US.
So unless USCIS see's a way of somehow screening out the best and the brightest and weed out these consultants so only the best and brightest are brought in, I can vouch that a majority of the American Technology companies (Cisco, Intel, Microsoft, Qualcomm etal) do not abuse the H1-B system neither do they undercut wages. welcome to the world of retrogression. it is only going to get worse from here on out.

Hi,
I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.
I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.

Agree on ur second point, however I was surprised with the context that "ok lets see how much we can buy the MS course and how soon can i finish it" as supposed to it will be great to do MS and lets see how I can furtherey ar my career with an added benefit of getting C in case of GC process.

I am not so sure if the CIR bill will help us. Allowing 12+ million illegals into the same system that we are in will totally screw up our chances of getting green cards. Does the bill mention anything about increasing budget and manpower for the USCIS department to handle 12+ million potential applications? Considering that large numbers of the illegals are from a country which also has a specific country quota in the GC lines, will the bill increase drastically the number of Visa Numbers available??
This bill favors the illegals so much that even reading it makes me wonder how fair the system is to those of us who follow laws and file documents on time. What's the point? All of us should just forget about the rules and go do whatever job we want to do.

It increases the H1B numbers, it increases the amount of GCs availbale per year, it excludes dependents from the quota, it excludes STEM advanced degrees (currently employed as well as future students) from the quota, it does require the illegals to wait at least 6 years before they can file papers for their GCs and then thay get to be at the back of the line, additionally, if the SKIL bill provisions are also included as amendments, it will also provide a premium processing facility for I485. The SKIL bill also mandates the DOL to clear all backlog within 6 months. The thinking is that by the time the undocumented aliens (somehow, I do not like the word illegal) enter the pipeline, the current backlog will be cleared and all dates will be current.
Given, the uncertainity in the process right now, I still feel that CIR is the way to go. Also, if it were not for the issue of the undocumented aliens, there would have been no incentive or push to do anything about the system and we would be stuck with this system. As far as the USCIS efficiency is concerned, I would not underestimate them either, the USCIS is known to be very efficient when it needs to (prime example the spectacularly efficient and successful H1 B premium processing system) so keep the faith and help yourselves achieve your dreams :)

gc101, if you are not able to get married before you you file your I485 (by Aug 17th). I would recommend that you file alone. these are my reasons for this recommendation:
1) You have more options open to you for your wife after you file I485 (ie. throught family based categories, even though the wait time is 7 years).
2) If you don't file now and have to wait for you PD to get current, with the current laws that might be close to 6-7 years. In this time you might get your GC and your citizenship too. After citizenship your wife can get her GC very quickly.

The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing EID MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? There were 1M+ EB GC applications as of March 2007 (when Ombudsman's report was written). There will be 1M additional applications by Aug 17 2007.
Lets assume a very conservative #: 1.4M by Aug 17. Then, 1.4M/140K = 10 years minimum.

We have a few people making their way to USCIS - so we should know in sometime.
Actually when I say a few, there are probably only 3 or 4. Even after working the phones, emails and private messages, we could not get too many DC area members to help out.
If I have one regret for this campaign it is that I should have booked my flight tickets to DC - it would have been just so exciting to have such a good opportunity to voice our issues and concerns.

My Firefox shows the APril but IE shows the May. Try deleting the cookies, temp files, cache, etc.
I did all that but still show April 15. :(
