    Lou Dobs is going to talk about immigration legislation burried in defence spending bill (which is under debate now) now. He just mentioned that there are pieces of 'Amnesty' legislation in the bill and he is gonna talk about it.

    If anyone has DVR please record it and we can disect it and post it on you tubes.

    I also heard the same thing. It is not clear if whole immigration bill has been attached to defence bill or only illegal immigrant part of it.

    Unfortunately the Timing of IV Advocacy day, and also May 2011 VB schedule at a wrong date. If the Govt Shutdown due to the budget deadlock, I'm not sure how both of these days will play out. Any Idea guys. :confused:

    They generally request payment for cases that are within a certain interval of being current. For example, yesterday, we received a fee bill for an India EB2 case with a September, 2007 priority date that has been pending at the NVC for several years.

    Wait a minute, how was this India EB2 case even allowed to file I-485 when that PD has never been current? The lawyer alleges that it has been pending for several years.

    Does this "fee bill" have nothing to do with 485 filing? Is it just plain wrong or am I missing something obvious here?

    Perhaps he meant September 2006.

    Conspiracy? DOS is part of bush administration. And since the president is dissapointed because of CIR. He wants a back lash from immigrant community?

    It is going to be true. otherwise mathew wont shut down his work and post that AILF is going file law suit.

    I am suspecting that they made current because of lobby made by some big heads inorder to get support to pass the immigration bill.
    Since the immigration bill failed, DOS is going back to retrogression.

    Agreed. These numbers do not seem to be real load. At the time of July Fiasco as per USCIS's own notification total more than 250000 EB based 485 were filed and more than 350000 family based 485 were filed.I am quoting this based on memory so it may be possible that this quot is not 11% accurate may have some variation at that time but it is not completely wrong.

    The letter campaign resulted in 5000 odd letters from the entire EB community. This included efforts from some very hardworking IV people who did not spend time on the forums but went out and collected 100s of letters, one collected more than a thousand letters. So i am guessing that not more than 2000 EB folks got their collective butts to participate in the letter campaign.

    if you expect EB2 I and the so call US educated (i am too, hence i can use 'so called') folks to stop chatting on the forums and send money and letters in the tens of thousands, then please tell me want you smoke --- i would like to inhale some of that magic too.

    good luck towards your efforts. if you make it happen then, in all honesty, i would also like to nominate you to the core team, if you dont then i have a bridge in brooklyn that i want to sell.

    My priority date is current since september 2010.
    My H1B transfer application is with USCIS since Aug 27th, 2010. The date for transfer requested is Novemebr 1st, 2010.
    My I 485 was filed in Aug 2008. I have been working with the current sponsoring employer since 2005, no breaks.
    I am expecting an RFE for my I 485. Anyone who was in similar situation share what kind of RFE is likely to be issued? I already have a job letter from the new employer essentially stating same kind of work duties.

    Well, no - my basic argument is that the banks bloated up the 'real' asset value - I had the money then and I have the money now and I am still paying my monthly mortgage amount - the point is about the inflated housing prices.....with these banks knowing the actual value of the asset and still going ahead with the extravagant loans.

    From another point of view, tell me 1 reason why would you lend out money to somebody who you know would not be able to pay you back?


    Let me try to understand your logic. You don't have money and went to bank and requested that they help you out with a loan. They give you loan based on what you bid your house and it is all their fault. If only banks had refused the loan, you wouldn't have bought the house. Is this your logic? Do you ever think for yourself?:confused: I am not going to say that banks were not at fault. But to act like nothing is punjabi's fault is ridiculous.
    BTW if you think he can afford it now wait for another year. The full impact of these mistakes will be known by then. We will be deep into a depression. We will have on top of it ALT-A resets and his house will lose more than 20K for sure. My opinion would be to sell it now and take the hit or wait and lose more. The housing will not rebound to the 2007 peek for a decade.

    EB3 will not any visa from recapture bcoz it will go to EB2 first. EB2 line is not going to clear in next 10 years bcoz nowadays everybody applies in EB2 and as they move VB forward for EB2, more and more people apply for AOS and it never ends.

    So EB3 won't be benefited by recapture unless there is a clause specifically for EB3 allotment out of that recapture

    We need some numbers to back this up. I think you are saying EB2 will not become current even with the recaptured number. There is another thread for requesting numbers from USCIS about pending applications per category, per country. So, participate in that campaign as well.

    We need the numbers. I would have guessed roughly 50% of pending 500K applications are from India, 50% of that is EB2, so recapture of 200K visas should help.

    My case is at the local USCIS service center. I opened an SR on Aug 12 and got an email response encouraging me to apply for an Infopass appointment: "We have determined that your case would have a better result if you make an appointment to visit your local office, so you may speak with an Immigration Services Officer about your case."

    I now have an Infopass booked. Let's see what happens. My case is pre-adjudicated since we had an interview two years ago.

    Should it go any further this way, can anyone please explain the process of Ombudsman / Congressman / Senator et al?

    hello, my case is exactly same. lying in uscis san francisco office. interviewd 2 years back.
    still waiting. i took an infopass at the local office but no use. the IO told me wait for 60 days and you would hear something.

    My new theory is the DOS was influenced by politicians who are attorneys (I beleive that there 50% of lawmakers) and it released a huge Visa Numbers. The politicians have strong connections to law firms. The USCIS doesn't want to do it, because it doesn't have 'resources', 'money', 'manpower. So, they are on a near strike mode, not attending routine works like sending receipts., etc in a timely fashion.

    Many issues are being swept under the carpet. I had written a few times earlier. The backlog and GC issues are not truly a numbers game. It is the neo-con regime and the republican culture that had engulfed Washington, its consequences, that had made things miserable for us; we, the legal immigrants.

    4/5ths of the illegal immigrants have been here by the time of Clinton's second term. It was a non-issue then. You should understand why is it an issue now? Why can't it the legal and illegal immigration be addressed and solved. In a democracy, things like this can be solved administratively, legislatively and judicially. Adminstratively, we we hit below the belt, in backlogs, in delays, in sudden rule changes (no concurrent filings of PD is not current). Legislatively, they are stalling and falling apart. What is left for the immigrants?

    I had written many times earlier.

    Why should you know? Why should you understand? It is in your own interests that you understand things wisely. Failure to know what is happening on the ground, what is happening around us is a sure shot for personal failure.

    If these #s are released, lets say 12K, or whatever:
    How will these affect the processing times.
    I guess these cases that qualify are all propbably pre-adjucated. In that case will it increase the processing time for PERM, I-140 and 485 stages.
    How will EAD and AP extensions get affected.

    In my opinion it is very naive to think that USCIS/DOL just realized that they had 'misinterpreted' the law. ..... The ambiguity of the law for the preference of vertical vs. horizontal spill-over allowed them to do that.


    In a couple of my previous posts I copied the relevant Sections (Sec. 202 and 203) of the INA which specifically states that distribution should be preferentially horizontal. Both Sections should be read together.

    Please note that there is no ambiguity in the law and DOS may just have taken too long to change the US Code or other relevant section of their rules.

    I will definitely be willing to change my interpretation if you can show where the ambiguity in the law lies. I'm definitely not a lawyer so it's quite possible that I'm missing some clause in the law.

In preparation of the May 2011 Visa Bulletin, DOS will consider the approximately 12,000 unused EB-1 numbers that will "spill-down" to EB-2, EB-2 demand and possible unused numbers, and will consult with USCIS on its processing potential. A quick look by DOS at this point indicates that there is the possibility for greater advancement of the India EB-2 category than had earlier been thought. Doing so will give DOS better visibility into EB-3 upgrade demand in the pipeline, and will better ensure that all visas allowed annually are used. However, a rapid advance could spur a surge in demand that could impact the cut-off dates later in the year. The May Visa Bulletin, generally issued mid-April, will contain a discussion of visa availability projections for the remainder of the year.

    I called the Nogales (mexico) US embassy and they were able to look up the PIMS system using the petition number.

    I hope the PIMS is a "centralized" system. So even the consulate in India would be using the same.

    But haven't got response from NSC or Ombudsman..

    TSC people are thinking smart by sending "Contact Help Desk" letter
    to everyone.. They don't even see what's in the letter and why 100's of people sending same letter. Sigh.. :mad:

    Because - it is a legal issue and they have to deal with it carefully.
