What part of Canada did you move to?
I am from India and I have worked in the USA for the last 6 years. I have immigrated to Canada with a Job 6 months back to avoid overystaying. My experience in Canada is very bad. I am a MCAD and Sun Certifitied Developer having more than 8 years experience. I am looking for a job for more than 3 months in Canada and still not able to get a job. There is lots of racism here and people are not polite. I have been regularly applying for .NET jobs and the response is very bad. Maybe because I am from India. Try avoiding Canada as much as you can.

Correct, there are problems with the online status with TSC.
My AP status say pending since 10/04/2007, I got my AP documents from attorney this afternoon.Still the status says pending.
I ve heard of problems with online status with TSC.
may be TSC is updating statuses weekly or something....

Can anyone with some indepth knowledge predict availability for EB3 Rest of world (Canada). Here is some of what I understand - although I know it may be wrong (some infor from Shusterman site)....
- 300,000 applicants in BEC
- assume 200,000 get through
- assume 1/2 have a spouce and 1 child
- therefore need 400,000 visa numbers (Shusterman had 300K here, I think they are wrong??? - pls check my math)
- now most EB immigrants are from China & India (half?????) - restricted to 7% of the annual 140,000 EB visas annually
- all* applicants up to first half of 2002 are "gone" - *except for ones in BEC = how many????????????
- AND if rest of world is 200,000 people in line for 120,000 visas annually (140,000 - 7% China - 7% India)
- now people in line go from 2001 - mid 2005 in BEC??????; but very few 2001 & 2002s left????
- thus: rest of world with PD of March 2004 - should get visa availability within this fiscal year - e.g. by Oct 2007????

It will bring down the workload? Can you explain how? If anyone in the world is eligible to apply for the GC without sponsorship, the system will be flooded with applications, irrespective of whether they carry any merit or not. What makes you think that an organization that cannot process 140K applications per year can handle millions?
The point based system sounds great in theory, but cannot be implemented efficiently by the U.S. as long as it remains the most desired country for immigrants. It works for Canada, Australia and the U.K. because fewer people want to move there.
Anybody wont be eligible. Canada has been fine tuning the immigration since 2002.
Now only people who have studied or worked in Canada on work permit are eligible.
family based is greatly restricted unlike US where around 80 is non-skill based.
If they want they always reform but the exiting H1B is so good for American Companies that they will fight to keep the existing H1B-GC servitude instead of
any point based..
Plus there is politics of vote bank: Moment the CIR comes, the sheer stampede of illegal lobby like the bulls of Spain, H1B folks get crushed. Last time, moment the CIR came, H1B people started opposing it because it literally made illegals ahead in line line with more points in the point based system.
That's why I am skeptical of CIR as of now. H1bs don't have much chance in front
of the madness of illegal lobby vote bank. Based on my observations of how the
US politics works I don't see promise in CIR (one of main reasons I left for Canada)
Not to mention, a lot of antis are not that against EB reform but moment CIR comes
all anti-s get united in opposition. The illegal bobby hold H1Bs as hostage unless they get what they want. It is such a deadlock that I just don't see how it can be fixed.
Unless there is another super powerful lobby helping us like US industry (supreme powerful lord in US politics) which currently wants the existing H1B system I don't see headway.
PS: In 2002 Canada passed IRPA where they delegated the rule decision making to the executive branch unlike US where any change has to be legislated.

I don't know how to open a thread to run a poll to track the number of people ready to send flowers to white house/president to highlight our case to buy houses if there is a a provision to approve GCs on a fast-track basis. With a substantial fast track fee (>4000 dollars) and 20% down payment toward house payment, we have a strong case. If we get hundreds of people ready to send to flowers, may be IV can make it an action item.

Btw, if the visa bulletin is not out yet, its a good omen. Over the years it has been observed that whenever visa bulletin comes out a bit late, like between 13-15 of a month, it moves the dates quite a bit forward. The bulletins that come out early in the month, like before 10th day of the month, truly sucks.

you said you are EB3 ROW (Bangladesh) but you applied your I-485 on June 29, 2007 with a Priority Date of Feb 06.
But on June 2007 (just before the VB fiasco) the Visa Bulletin for EB3 ROW was caught up to June 05 (http://travel.state.gov/visa/frvi/bulletin/bulletin_3236.html). But your EB3 ROW PD is Feb 06. So how is that possible?
Only EB2 ROW is current. Are you sure you are not EB2? You can confirm this by looking at your 140 notice. Otherwise you must have sent out your application June 29 (Fri) in the hope of reaching USCIS by July 1 or 2 (Sun or Mon). That's the only way I could make sense of this.

Instead of fighting EB3 or EB2, can we throw up this idea -
Whatever be the priority date - whether EB2 or EB3, a person should submit proof of filing Income Tax from the time they were in US. This way a person who came in 2001 and filed for labour in say 2002 under EB3 - will have higher priority (provided he/she submits Tax filing proof for 8 years) than a person under EB2 with 2006 priority date and filed taxes only for say -4 years. (or the same person who moved from EB3 to EB2 can also benefit from this) i.e. the priority should be determined based on how much a person has contributed to US economy. For the Govt. to generate some money, all GC applicants can be asked to pay a small fee(say $100 per applicant) to IRS to get proof of filing income tax returns.
Just my 2 cents.

i am not sure why you think kavya wont excel in her life - she already has a great headstart with close to 40grand in winnings! i also dont know why you think she will end up working for a non-ivy league educated manager - & even then why its a bad thing to win a spelling bee..too many gaps or leaps in thoughts/logic?!
If you come across and experience families who make their kids to go through the labor (hell) then and then only you would understand what he is trying to say. The other way of experiencing is to watch the pattern and construct of these spelling bees carefully and apply your own thinking process. Once you do this you would almost agree what logiclife was trying to throw to us.Spelling Bee competition, though make a child well aware about the roots of the words (latin, Greek roots) and provide enough exposure to the kid to understand the English language in its essence, it does not teach a kid how to think, how to become creative and innovative.
Of course nobody can generalize that particular winninng kid will/may/won't/may not do good in life but more or less these are not the competitions through which parents with reasoning or thinking ability would let their children go. Yes there are some advantages but if you try to enlist then list of disadvantages would become lengthier..

Did you or someone you know experience such questions at POE for an advanced parole? Or are you just posing a hypothetical?
I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.
Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.
If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.
Too much thinking and too much analysis has caused this community to revert back to H1 lifestyle and they are not using EAD and AP - ONE OF THE MAIN REASONS why we were all so happy due to 485 filing.
What is the point of having an early 485 filed, if you are not going to use EAD and AP and be at mercy of consulates for restamping and be at mercy of employers who will need to sponsor you to hire you?
