I-140 premium processing was stopped last year...It takes upto a year or more to get I-140 approved, that too if its a direct case...If its a interfiling case to capture PD from Eb-3 to Eb-2, then its taking even longer..One of my friends filed I-140 in March 2007 to capture his Eb-3 PD of Apr 2004 to EB-2 and he is still waiting....I-140 processing dates are well beyond his receipt date but still his application is pending....So porting PDs is not that straightforward these days...

If they state their reasoning behind these processing times and let us know in writing that only apps with current priority dates are being considered, that will put to rest a lot of our anxiety.
As much as I am anxious to know about the application being approved, the lack of transparency is what frustrates me the most. They create the rules and they bend it as and when it suits them.
I wish they would only state the true state of affairs.

I don't think there is any way of knowing if your case is pre-adjudicated. The only way you will come to know is if you receive an RFE or an interview appointment.
Although officially so far, USCIS has not branded an I-485 status as "pre-adjudicated", if you haven't received any RFE and/or any other negative status about your 485, and if your case is outside the processing dates of the Service Center, then obviously dude your case is pre-adjudicated. I don't understand why most of the people are ignoring this simple fact. I think we need to stop consider USCIS a mystery box, and start treating it like an organization that processes the applications in a structured way.
I tend to believe that the offical status of being "pre-adjudicated" is coming soon. A few months back I read that USCIS is considering publishing another set of date known as "Qualifying Date" in their monthly visa bulletin. That date will define if you are "qualified" to file I-485. They will determine this date based on their workload. The idea behind is to avoid another July 2007 fiasco. They intend to process the 485's early rather than have you wait for your PD to become current. That way they will manage their workload efficiently and avoid visa wastage. They did indicate these applications to be pre-adjudicated then. I am guessing the official status of "pre-adjudicated" on your 485 application is coming soon.

I came here as a guest, started reading the forum posts. Later realized some threads like 485-Filing and EB2-EB3 predictions require membership. this poll is a good idea to understand what most of the members expect from CORE. I for one am looking for any updates about (1) new bills being proposed that we can support - calls, faxes etc and (2) any infomation that can help to "predict" whats happening with USCIS efforts to use all visa # (yeah, sorry.. had to use predict and USCIS in same sentence) (3) updates on efforts towards FOIA, country caps remoal, capture of unused #s, .... and anything and everything you can throw at me about immigration...
but I also understand that most of these lobbying efforts are done in the back ground and its not good idea to share anything in these times. who knows, may be there is an anti-immigrant lurking around (ofcourse paying $$ to become Donor, become senior member whatever) to get inside information. I would rather trust the CORE to do their work and give me directions when they see fit.. like meeting local senators etc..

I don't think asking updates every week because you contributed $25 or $50 is fair.. just my thoughts..

5) Most desis are hard working and responsible people - nothing should hold them back - not certainly the need for an image makeover.
All fellow desis take care and enjoy your life here - life is too short to be depressed about the green card everyday. Most important thing is you stay happy everyday - here or in India.

This is like the banana joke in an old tamil movie, it is over 157 days and the USCIS now wants to go by processing times which mention july 3rd processing date, which is still late, but then they will say it is just one day over your receipt date.

I am on H1 and my wife on H4. Can she apply for EAD while I do not ( I would prefer to extend my H1) after we both apply for 485?

Thanks Almond. At this point, I am hoping USCIS will at least allow me to change jobs (remember - I am on 7th year H1b - approved I-140, did not apply for I-485 due to retro). some members here said this is possible and some other members said I cannot do this. so I am confused if I can do this or not. If at all USCIS lets me do this, it would be great if I can find a new employer who can do EB-2. I am praying to God to help me while I try this route. I am not asking too much here... am I ?
No, not at all. It's perfectly normal to want to advance in life and to want to move on to better things. I think the best thing to do right now would be to go for a consultation with an immigration lawyer. Or, if you cannot afford it maybe you can schedule an InfoPass appointment and ask the rep there what your options are. But I'd say a lawyer would be the best option.

Next Tuesday, Luis Gutierrez, the chairman of the Congressional Hispanic Caucus, plans to introduce his version of CIR. It will most likely concentrate on amnesty.
At some point in the future, we can expect a bill from Zoe Lofgren. The Lofgren bill will be the one that will have bi-partisan supporters and will be taken seriously. That will be the "real" CIR proposal in the House.
If I had to bet on it, my bet would be that if anything at all passes, it will be visa recapture, quota expansion, and H1b relief. There is a strong core of support for those measures. The weakest component of CIR is amnesty.

In my humble opinion, if people who have been illegal in US for over 5 years are granted legality, then the govt should
1) Close the backlog processing centers where our cases have been languishing for years
2) Grant us green cards if we can show minimal proof that we did infact file for permanancy legally at some point in time.
I mean COME ON guys..the government is giving legal status to more than 10 MILLION illegals in this country, yet when it comes to 300,000 tax paying, qualified, LEGAL, degree holding H1B workers, the same government is penny pinching and trapping us in a bureaucratic paper nightmare. What is 300,000 when compared to like 13 Million?? Its a drop in the bucket. Do not forget that our employers have paid big bucks for every H1B, and additionally paid for the creation of the backlog reduction center, where they are painstakingly poring over each and every case with a toothcomb.

This is a country where capitalism is practiced at its extreme....
The drawbacks of capitalism are also seen here in their extremes....
Exactly when people get into situations like what 'desibechara' described, the socialist healthcare system of Canada scores big way!
Through my 3 year stay in Canada, I was made to pay 43% of my income as income tax - a lot of people around me would grumble about that, but I for once, have never felt bad about having to pay such high taxes in the interest of a socialist healthcare system...
It gives such a peace of mind knowing that one never has to worry about getting medical attention all our life...irrespective of our job situation....stories of people having to sell their houses just to get proper medical treatment are just unheard of...
