I am guessing that we are on our own on this, it will be an unnecessary headache for them. if they go ahead with any movement on this issue EB 2's will get pissed off, if they dont respond positively then the EB3's will react negatively
We can try on own by posting your question on the website of different immigration lawyers, who knows, they might have an opinion or can suggest a direction.
Not excatly. eb3_2004 has posted the link of INA. You will find more interesting things if you read through it.
Non-descrimination rule is clearly spelled out in Section 202 (a). I assume this rule should be generally applied to all applicants, no matter which categories they are falling, unless other rules specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203.
INA does not say to spillover unused visas first to EB2 then EB3. I assume USCIS and Department of State should treat each EB applicants equally (based on their priority dates, not based on EB categories) in according to INA act.
It is likely the misinterpretation violates the law. We need some one which more professional knowledge to read through it. Can some core member help?

Is that mean they are going to move the PDs much further and again move back during the end of the year!!
So isn't this implying that the PDs will advance very very further than the available visa numbers!!!!!!!!!!
.
"Cite as "AILA InfoNet Doc. No. 11040563 (posted Apr. 5, 2011)"
Following-up on his earlier observations on EB-1 demand and "spill-down" to EB-2 reported on InfoNet on March 29, 2011 (InfoNet Doc. No. 11032960), Charlie Oppenheim discussed scenarios for EB-2 movement in the coming months. In preparation of the May 2011 Visa Bulletin, DOS will consider the approximately 12,000 unused EB-1 numbers that will "spill-down" to EB-2, EB-2 demand and possible unused numbers, and will consult with USCIS on its processing potential. A quick look by DOS at this point indicates that there is the possibility for greater advancement of the India EB-2 category than had earlier been thought. Doing so will give DOS better visibility into EB-3 upgrade demand in the pipeline, and will better ensure that all visas allowed annually are used. However, a rapid advance could spur a surge in demand that could impact the cut-off dates later in the year. The May Visa Bulletin, generally issued mid-April, will contain a discussion of visa availability projections for the remainder of the year.
My comments earliar this morning.
I checked some family based data and Date jumps 2-3 years once in a 2-3 year period and NVC gets enough files to work on for next 2-3 years , so dates moves slowly for next 2-3 years. USCIS learned lesson from July 2007 and may follow same approach what NVC do.
They might go upto 2008 or 2009 in advance this year or next year so they have almost 20-30 k Eb2 cases on hand which can last for year or two. USCIS needs some new cases to work on. All pre adjudicated cases are ready for approval so chances are there they can advance date so that they can get enough cases for next year's spill over quota.

Atleast the Director is now aware of the sufferings of GC filers.
The flower campaign (http://immigrationvoice.org/forum/showthread.php?t=6191) is getting heard.

Message from USCIS Director Emilio Gonzalez
I understand that individuals are planning to send flowers to U.S. Citizenship and Immigration Services (USCIS) beginning on Tuesday, July 10. USCIS has made arrangements to forward those flowers to our injured service members recuperating at Walter Reed Army Medical Center and at Bethesda Naval Hospital.

I had a pre-scheduled appointment to meet my congressman's rep in his office today. I mentioned to him the issues and gave him the letter. He said addressing the president won't be of much use as it these fixed need to be taken up by lawmakers in the house. He said due to election year nothing will happen until 2009 as it requires legislative fixes and he expressed about the omnibus bill getting declined !

There are 3 kind of jobs -
1. Jobs that require active security clearance - this kind of job is only limited to US citizen that have security clearance of that level. Yes, tehre are different levels in security clearance as well.
2. Jobs that will be in unit where everyone must be US citizen. These kind of jobs can be filled by US citizen without the need of any security clearance.
3. Jobs that are open for everyone - One must have active work authorization.
The vast majority of the jobs are of type #3. In any case, if job requires US citizen, the hiring place must be able to answer why that job is restricted to US citizens only.

Let me share my wife's bitter experience. She told the employer about EAD. She got interview thrice and selected. Offer letter came and they mentioned that it is only allowed after the security clearance such as NAT.
Employment verification was success.
Then when they sent papers to NAT clearance they rejected immediately as for NAT clearance one must be Green Card holder atleast.
The HR department mentioned sorry for their confusion as they themselves completely do not understand the whole thing.
So, any security clearance jobs for Govt/Military/AirForce dont waste your time if you are EAD holder.

I have a WAC number and petition approved in Feb 07. Stuck here for 1 month, 18 days and counting. I called DOS and didn't receive a positive response. Will try calling KCC tomorrow.
Good luck to you.. I understand it is really frustrating... and they don't really care for us.
if more people post their details then we might be able to conclude something.. there are always exceptions so it is very difficult to figure out.. (well, it might be possible that there is no pattern but if we get more details of more cases then we can think something... after all we can't do anything apart from this ... )

In reality How USCIS divide 28.6% among countires - That is unknown mystery and nobody surely know that. And that is why I had to assume "equal shares - 5 part" in my analysis assuming USCIS works fairly but we all know that is a bullshit too :)
Look at histrocial approval you will know your assumption is incorrect. ROW gets more than half the numbers in any category.

Guys... I am all to do anything for GC, that itself is big thing..
Anybody in this thread who support this idea and was here since 1998
pls come forward...
Then you really know , what it is about...
Upto GC, it is fine to do any movement/lead..perfectly acceptable.
But do not waste energy and aggressivness on citizenship related things. It rather damages the effort, just by adding citizenship related things.
It is as equal as what happened in the past, that adding illegal and legal based reform in teh single capsule blowed out everything and no benefit came out finally.
Now
i am asking you guys in this thread...
who support this idea and was here since 1998 or atleast from 2000
(Pls note you shd have started your GC process on or before 2000. Then you know the things.
If you came in 1998 and started GC just 1 or 2 years back..You may not be knowing the reality.)
pls come forward...
I am not questioning or discouraging your intentions/enthu/aggressiveness...
I am asking not to waste the energy on useless things.
Pls concentrate on GC related things which will benefit everybody.
People laugh for the resolutions you suggested , if they can be proposed to any legislative member.

My status was changed from Initial Review to PDA.The status changed on Aug 7th. There is no CPO or Decision status in between.
I see the following message
On August 6, 2010, we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.
I got my 485 Approval notice copy on Dec 13th and haven't received any welcome letter or my actual card.
Is any one in the same state. How long does it take for the actual card to come.
I need to renew my DL by end of this month. Can I renew it using my 485 Approval notice copy?
Thanks
Bala

Oh, did that comment on Brahma and Saraswati incest hurt you? tsk, tsk, tsk.. too bad.
Well, you should have read and responded to the comment before that before pretending to be hurt about my response. I didn't start it.
If you are ready to make such bigoted comment, NEVER expect that you can get away that. Believe me, internet is limitless and I can shovel dirt about India in this forum, if I want to with a google search(which is not my intent here)
Yes of course, I didnt go to any american forum to shovel dirt but you did come here just like Bush doctrine of pre empting anyone who you are remotely jealous about. So it shows who is bigoted & uncivil. It does talk a lot about your "mentality" or rather american mentality.

CNN Shifts Slot for Dobbs (http://www.nytimes.com/2007/10/16/arts/television/16arts-CNNSHIFTSSLO_BRF.html) By BRIAN STELTER | New York Times, October 16, 2007
CNN will move Lou Dobbs Tonight to 7 p.m. from 6 p.m. and introduce a three-hour block of the late-afternoon show The Situation Room next month, the network said yesterday. The unusual decision to move Mr. Dobbs the host of CNNs second-most-popular hour is intended to bolster the perennially low-rated 8 p.m. hour recently vacated by Paula Zahn. The former NBC anchor Campbell Brown is scheduled to be the host of a new 8 p.m. program starting in February. The move will put Campbells new show in between our two highest-rated programs, said Jon Klein, the president of CNN/U.S. The only program with more viewers than Lou Dobbs Tonight is Larry King Live at 9 p.m. The Situation Room will be broadcast from 4 to 7 p.m. In the schedule shuffle, CNN risks losing the loyal audience for Mr. Dobbss passionate coverage of immigration, outsourcing and politics. Mr. Klein said Mr. Dobbs and Wolf Blitzer would repeatedly promote the changes ahead of the Nov. 5 move.
