still something is wrong. USA does not descriminate based on country of birth, in this case there is a punishment for being born in india.
I know, it is unfair and frustrating. But from legal point of view, you are mixing Employment Laws with Immigration Laws.

Disclosure : I have already received 2 year EAD (thanks to IV). I have taken initiative to bootstrap the effort to help others who haven't been so fortunate. Since we are all in the same boat let us watch each others back for a change, instead of trying to backstab each other at every available opportunity.
This is NOT a yet another case tracker /EAD tracker thread. I don't believe that just tracking stuff will change anything. Be it EAD issue or any other, real world action is needed to solve it.
I have started this thread to guage the impact this issue has had on our community , how many members are affected, what actions have been taken by them, so that next steps can be taken. If a large number of members are impacted IV may decide to take up the issue.
Here are the options available to applicants
1) Call National Customer Service Center and create a Service Request (SR) to expedite the case
2) Fax and mail a letter to Service Center requesting to expedite the case due to possibility of job loss. Since the burden of proof is on the applicant - a letter from the company that EAD is necessary for continuation of job may help.
3) If steps 1 and 2 don't produce the results and CRs refuse to open SRs citing silly reasons, USCIS Ombudsman may be approached.

4) Approach your US Congressmen/women Representative/Senators. Every office has a different form for requesting Immigration help. They can open an inquiry with USCIS on your behalf.
Following the above (4) steps is no guarantee that your case will be resolved. But it is necessary that we follow all possible avenues before the issue needs to be escalated. We shouldn't feel embarassed at the question "Did you follow up with all these avenues available to you?". Our answer should be - "Yes. We did all that and it didn't help". And we should be able to produce the proof that we did do all the four steps mentioned above.
If you have done all the four or after you have exhausted all avenues, AND are willing to take it further - speak to the media, participate in possible IV campaign etc., post your details. We need members ready to go public with the issue if we want to succeed.
Right now, I have started this as an individual initiative. But I am sure that IV will get involved once it's proven that a large number are impacted and there are enough members to turn it into a campaign.

The number of people prior to Jan 05 is up to 89 and I am sure it will keep peeping up.
The factor of 100 (1 % polling) seems to be a realistic assumption.
Considering the above numbers/assumptions we are looking at the following number of people awaiting approval next month:
89 * 100 * 2.25 = 20025
By this poll/statistics somewhere between 20K - 25K people are awaiting approval next month.
Also there seems to be no more approvals as per after 08/21. Either all the people have been greened (barring a few with some complexity in their case) or the visa numbers have been exhausted(I do not think the latter is the case).
Hopefully a big chunk of these people do get their approvals next month.

The poll shows that there are substantial number of cases from Yr 2004 or earlier. This shows that the Dates will be going back in October Visa bulletin. If the number of applications are 50 times of the polled numbers, then also it will take 2-3 years to clear the Yr 2004 and earlier applications.

You are absolutly incorrect. Unfortunatly most lawyer or their web sites do not explain the limitation of "parole". Because most of the CBP at POE are flexible; that does not mean that the law is flexible. This is what the instruction for AP in the form.
"Advance parole is an extraordinary measure used sparingly to bring an otherwise inadmissible alien to the United States for a temporary period of time due to a compelling emergency. Advance parole cannot be used to circumvent the normal visa issuing procedures and is not a means to bypass delays in visa issuance."

Need Approval in Hand.. Receipt Notice Does not work in most of the states and new states are adding this as requirement every month...
I had similar issue for my spouse on H4. Was out of license for about a month... It would be a good issue to be brought up at Sep 18 Rally and added to core issues handled by IV in general. Lots of future immigrants are facing this.. But we need a collective voice as usual with any immigrant issue to get a resolution.. More and more states are joining to make Driver License as your "Immigration Status Document" causing "LEGAL to work but NOT LEGAL to drive" situation....

EB3 is not working, because we have no hope, not because we all went back or have ported.
Only EB3 India has problem. EB3 ROW has no problem. EB3 China are very few.
In EB3 India most people are trying for porting or have gone back. I do not see EB3 India anywhere on forums showing pain. It is mostly EB2 India doing work,

Every effort should be undertaken to identify and remove persons who pose threats to the United States, which would include rescinding immigration benefits after USCIS has granted them. It would be irresponsible for law enforcement entities to stop their investigation of a potential crime merely because the person who is the subject of their investigation has obtained a green card or U.S. citizenship.
Similarly, it would be illogical to think that delaying issuance of a green card or U.S. citizenship will prevent a criminal from committing a crime. Considering the protection the FBI name check provides, the cost of government resources used, and mental and actual hardships to applicants and their families, USCIS should reassess the continuation of its policy to require FBI name checks in their current form.

Personally I think these processing dates are crap , It use to be valuble before July-07 but not any more.
I think if CIS use computers and run a small query they know how many cases are pending which fall under processing dates
The only advantage with the dates is opening SRs, which dont have any value and complete waste of time.
My EB3 140 was filed on July 5 th 2007 at NSC and transfered to TSC on April 07 08 , for TSC 140 processing dates are Aug 26 07 . I guess they have their own rules for transfer cases .

Please shut your mouth. You do not know and feel what we are going thru (PBEC victim). As a member of this community, and have contibuted monetary support, I too, would like to have the problem in PBEC be heard.

With all due respect to your point of view without being rude, I am a BEC victim from April 2001. I have been waiting to get my Labor Certification from April of 2001. Till date, I know it may be in one of the BECs if it wasn't lost in transit. I was not able to obtain a screen shot nor do I have a 45 day letter. Still I say, when setting priorities, set it on what can be accomplished in the next two weeks, I agree with you in using the IVs opportunity to speak to bring all issues. But definitely not agree with your tone of voice. IV has clearly stated in its media relations page that members that have no respect to opinions and have no decency in their language can be taken out or censored.
